Terms of Service

Last updated: April 2026

Agreement

These Terms of Service ("Terms") are a binding agreement between you and VibeWorks ("VibeWorks", "we", "us") governing your access to and use of the VibeWorks website, applications, and related services (collectively, the "Service"). By creating an account, uploading content, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and Accounts

You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is greater) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for the activity that happens on your account, for keeping your login credentials confidential, and for promptly notifying us at hello@fluencity.ai if you suspect unauthorized access. We may suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.

Acceptable Use

You agree not to use the Service to:

  • Upload or share content you do not own or have permission to use, including code, conversations, or work product owned by an employer or client without authorization.
  • Upload material that is unlawful, defamatory, harassing, infringing, malicious, or that contains personal data of others without their consent.
  • Attempt to access, probe, or scan accounts, infrastructure, or data that do not belong to you, or to circumvent authentication, rate limits, or other access controls.
  • Reverse engineer, scrape, or use automated means to extract data from the Service outside of officially documented APIs.
  • Use the Service or the AI Coach to generate content intended to harm, defraud, impersonate, or deceive others, or to evade safety filters.
  • Resell, sublicense, or operate the Service as a hosted offering for third parties without our prior written consent.

We may remove content or restrict access where we reasonably believe these rules have been violated.

Your Content and How We Use It

"Your Content" means anything you upload, link, or input into the Service, including chat transcripts, repository links, project files, portfolio copy, and AI Coach conversations. You retain ownership of Your Content.

You grant VibeWorks a limited, worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, transform, and display Your Content solely as needed to operate and improve the Service for you, for example, to compute fluency analyses, render your public portfolio at your request, and route messages through the AI Coach.

We do not sell Your Content. We do not use Your Content to train third-party AI models, and we do not use it to train our own models without your explicit, opt-in consent. Anything you publish on a public portfolio page is intentionally publicly accessible.

AI Coach and Automated Analysis

The Service uses third-party large language models to analyze uploads, score fluency, and power the AI Coach. AI output can be incomplete, inaccurate, or out of date. You are responsible for reviewing AI-generated suggestions before relying on them, and you should not treat scores or recommendations as professional, legal, financial, or career advice.

By using the AI Coach you acknowledge that your messages and the relevant context from Your Content are sent to model providers under contractual terms that prohibit them from using your data to train their general-purpose models.

Plans, Trials, and Payment

Some features of the Service are free; others may be offered as paid plans. Pricing, billing intervals, and trial terms are presented at the point of purchase. Paid plans renew automatically until cancelled. You can cancel a recurring plan from your account settings; cancellation takes effect at the end of the current billing period.

Except where required by law, fees already paid are non-refundable. Payments are processed by our third-party payment provider; we do not store full payment card numbers. If a payment fails, we may suspend access to paid features until the balance is settled.

Intellectual Property

The Service, including the VibeWorks name, logo, software, designs, and the fluency framework documentation, is owned by VibeWorks and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to access and use the Service for its intended purpose, subject to these Terms.

Feedback you send us about the Service is non-confidential, and we may use it to improve the Service without obligation to you.

Third-Party Integrations

The Service can connect to third-party platforms (such as GitHub, Replit, Vercel, and LinkedIn) at your direction. Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for third-party services, and a third party changing or discontinuing its API may affect features that depend on it.

Privacy and Security

Our handling of personal data and security practices is described in our Security Policy. By using the Service you consent to the collection and use of information as described there.

Termination

You can stop using the Service and delete your account at any time from your settings. We may suspend or terminate your access if you materially breach these Terms, if your account creates risk or possible legal exposure for us or other users, or if we are required to do so by law.

On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will continue to apply.

Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, VibeWorks disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated output will be accurate or suitable for any particular purpose.

Limitation of Liability

To the maximum extent permitted by law, VibeWorks and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the twelve months preceding the event giving rise to the claim and (b) one hundred U.S. dollars (USD $100).

Indemnification

You agree to defend, indemnify, and hold harmless VibeWorks from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Service, or content you upload that infringes the rights of a third party.

Governing Law and Disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in San Francisco County, California, and you and VibeWorks consent to the personal jurisdiction of those courts. Nothing in these Terms limits a consumer's non-waivable rights under the laws of their place of residence.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, give reasonable notice (for example, via email or an in-product notice) before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
